What the mother of that child did MAY technically be considered assault, but I don't think there is a Judge in the world that would convict her for hitting a 17 year-old that was committing statutory rape on her child. Moreover, she would have an excellent defense, which is that she was defending her child from a sexual predator. Your nephew made a very bad mistake and he will likely have to pay for that mistake for a very long time. If he is convicted, he will be considered a sex offender and he will have to register as one possibly for the rest of his life. He needs to find an excellent criminal lawyer instead of worrying about the bruise on his cheek.
