Legal Question in Personal Injury in Louisiana

A little under a year ago i was at school and this kid hit me in the back of the head with a skateboard and while i was on the ground he continued to kick me in the head until teachers came to get him off of me. Well now i have to go to the doctors frequently because i now get major migrains, blackouts, and dizzy spells, i was wondering what i could do about him?

Harm caused by a child under age 18 is the responsibility of the parent.

It is critical that you see an attorney, as you only have a year to file suit for injuries and other damages such as medical expenses, lost earning capacity and any other disabilities and damages. Moreover, you need to get this to an attorney so that they can investigate coverage and attempt to work with a claims adjuster and/or the parents prior to the one-year prescription date. Litigation is not pleasant and you may be able to collect without going through the rigors of litigation. However, by holding off until near the end of the year, you give the attorney little time to work the file without the necessity of filing a lawsuit. Once a suit is filed, expect considerable delays. You have one year to file a lawsuit if you want to try and collect damages for your personal injuries, medical and prescription bills, loss wages, etc. You do not state your age or the age of the person that hit you. If you are a minor speak to your parent or gaurdian about hiring an attorney and attempting to recover for your loss. The possible defendants are the person that hit you, his/her parent or gaurdian if they are a minor and possibly the school or school district. Remember, you only have one year from the date of the incident to sue and protect your rights.
