Legal rights of a roomer/boarder

My father is currently renting out a room in his home. There is no written agreement. If he is unable to reside in his home due to illness, or when he passes away, can the heirs of his estate evict the person renting the room? One of his sons has Power of Attorney. Does this person have any rights to stay in the house for any lenth of time? The roomer has been there since June 2000.

The renter is living there on a month to month basis. If the power of attorney extends to managing the house and the renting of it, then the brother can give the renter notice that the month to month lease will end at the end of the next rental period. To be on the safe side, give the renter a month's notice to vacate. If your father is deceased, then the power of attorney is voided by his death, and the heirs who will inherit the house are in control and may give the notice to vacate.
