roof drainage v/s tree damage

we reported a fallen tree onto our property and a rebutal came back that a roof we have connected to our fence drains water onto the other property, it was stated that we are not allowed to have anything within 5 feet of the fence, is there any relevance to this or would we just need a gutter to keep the water from draining onto the other person's property or is he just trying to come up with something since he's going to have to pay for our fence
