Legal Question in Wills and Trusts in Louisiana

Child vs Stepchild

Ok this is the scenario. My father has been divorced for 10 years. I am his only child. He is fixing to remarry soon and the future spouse has a daughter. How does this change the easy will I was going to be facing later and is the stepchild entitled to anything. This is property and house that I grew up on my whole life and I find it hard to believe the stepchild would have any claim. Also what does the future spouse expect to gain.

Re: Child vs Stepchild

First, I cannot tell you what anyone "expects to gain" because I cannot read the hearts & minds of others.

What you father owns (and what your future step-mother owns) is separate property. If your parents were married when the property was acquired, then your mother might have an ownership interest in the property if it is community property. Marriage does not give an ownership interest to a non-owner.

Unless your father executes a will giving property to a step-child, that step-child will not inherit from him.
