Legal Question in Workers Comp in Louisiana

new work injury - concerned!!!

my husband, a police officer; was injured at work and tore his acl, a ligament in the knee. our doctor is suggesting reconstructive surgery, which will most likely put him out of work for several months or longer. he is unable to work ''details'' for the extra money we despretly need and we are not supplemented for these ''details.'' even if he is put on light duty, he will still be unable to work the details or do his usual routine of working out and regular yard work. we have not contacted a lawyer, the police department is a close nit family. does workmans comp supplement for ''details'' and should we speak with a lawyer?

Re: new work injury - concerned!!!

Workers comp would pay 2/3s of his normal pay, unless there is a clause which would take into account his extra details, and state supplemental pay as well. If he worked after hours as security in the mall or at nightclubs, then I would doubt if that income would be covered. Of course, if he were hurt at one of the after hours jobs, then he'd be in trouble. Get in touch with your human resource person at the force, or whomever handles comp claims and they will shoot straight. The consequences of trying to cheat someone out of his benefits is too great for them to even try such a thing....normally speaking anyway. This is not like dealing with an insurance company in an auto accident. With WC, if the injury is work related, they have to pay.
