Legal Question in Credit and Debt Law in Maine

credit card debt

I am deeply in unsecured credit card debt. Have no assets except for my clothes and furniture. I am 67 yrs old, female, not concerned about credit score, tried to work with card companies but to no avail and wonder what will happen if I just stop paying these cards. I am on social security and work part time. I pay rent and am responsible for my heat, phone, lights, food, insurance, etc. How should I handle not being able to continue to pay these bills?

Firstly, there is a Consumer Credit Counseling service that you should talk with regarding all financial implications of non-payment. Secondly, as a legal matter the creditor(s) will each have the right to obtain Judgment, and subpoena you into Court to review your assets for a Judge to determine if you have the ability to pay. From your description, you may not be ordered to pay, but each creditor can go back to Court every 6 months so you may have to deal with the issue even if you are not ordered to pay. Thirdly, Bankruptcy is also a possibility but you would need to call a Bankruptcy lawyer to address that process.
