Legal Question in Real Estate Law in Maine

Hello there.

My ex boyfriend and I own a home in Maine.

We purchased it in 2001 for $66K and each put $6K down.

I moved out in 2003 (paid mortage for 2 years, 2 days).

Richard (my ex) is still living there and paying the full mortgage.

My name by the way is still on the mortgage.

He has just listed the house for sale.

I am wondering how much money I am entitled to?

Thanks.

Melinda

P.S. Richard says that by law I am not entitled to my down payment.

Is the home in both your names? If so, you're entitled to something. If you can't agree with Richard what that amount is, you may have to file a lawsuit to have a judge determine the amount due you.

I agree with Mr. Nye. Once the house sells and the mortgage is paid off, if at that point there is money left over you will be entitled to some of that. Figuring out how much of it will be the challenge.

Ultimately the court would try to split it as evenly as possible, so if you can get to that point without going to court you will save yourself a lot of money and time.
