Legal Question in Wills and Trusts in Maine

My father remarried, had a medical issue, and was declared unfit to take care of his own decisions.

My father is much better now(although not able to take control of his estate) but his wife will not allow him to come back home where he wants to be. I have provided a solution of 24hour care at a price that is lower than the cost of the health facility but the wife still says he cannot come back because she would not like to have other people in the house. My fathers doctor and the health facility both say that his is able to go home if we exicuted my solution.

My father has always had the desire to die in his own bed but yet no one seems to find that important.

It seems the only thing that is important now is the confort of his wife.

What steps would need to be taken to over rule the wife and allow my father to go home even if she did not agree?

If your father is of sound mind, he may want to grant you power of attorney to handle his return to home. It's something to explore with his doctor to see if he's able to understand the implications of signing such a document.
