Legal Question in Consumer Law in Maryland

I couple of months ago I drove into a construction hole. The construction company, which was commissioned by the state, did not properly mark the construction hole (putting markers only next to, and not in the front of the hole).

I have tried contacting the State Department of Transportation and they have not done anything to resolve the case.

Should I bring this case to a small claims court, and if so, who should I sue? I don't have any witnesses but I do have pictures. The damages amount to about $600.

I cannot tell you what you should and shouldn't do. If you want to sue (for negligently failing to mark the construction hole), the defendants would likely be MDOT, the construction company, and anyone else even remotely involved in the construction and/or marking of that area. Special steps must be taken when filing a lawsuit against a government entity -- you will need the help of a Maryland litigator. Consult one PRIOR to filing a lawsuit.
