Is the nursing home seeking the money from your mom's estate or from you personally? Did you ever sign an agreement to pay or co-pay your mother's bills? Thanks for your post. If an estate hasn't been opened for your mom, you will want to make sure this gets done. Maryland law sets a priority for the payment of a decedent's debts as well as a time frame for presenting any claims. If the debt is in your mom's name and there is not enough money in her estate to go around, the law specifies which bills get paid (expenses of a last illness come before certain other types of creditors). You may want to consult with an estate attorney to look at the nursing home demand and/or to help administer the estate.
