malicious destruction of property

i am being charged with smashing in a persons windshield. the thing is ,yes i did it and i am going to admit to it in court, but this is my first offense of any kind and i was heavily under the influence of alcohol. i am very sorry for what i did and have no problem paying for it. do you think i will get jail time

We need to know the jurisdiction and what is the attitude of the "victim". I wouldn't be so quick in making admissions at this point. You may benefit from an attorney to do the talking for you, this way nothing can come back against you. There is a good chance you won't go to jail. But you have to play it just right. Was anyone endangered? Anyone in the car? Was this part of a fight? If it's over $300 damage, you are looking at felony malicious destruction. At least talk to a lawyer before going to court, if you are going without one. The first thing the judge would want ot know, before you admit to anything is do you want a lawyer to represent you? The issue in any criminal case is not whether you committed the crime, but can the State prove you committed the crime beyond a reasonable doubt. Worse than going to jail, believe it or not, is the fact you will have a criminal conviction which will follow you the rest of your life. Don't play around with criminal charges, talk to a criminal trial lawyer, like myself, as soon as possible. Certainly do not admitt anything about your case to ANYBODY, until you talk with a lawyer.
