I reside in the state of Maryland. My question has to do with carrying a expandable baton for protection against animals. In the state of Maryland, is it legal or illegal to carry and use a expandable baton to protect against animals off leash or while in a dog park?

Md. Code, Crim. L. sec. 4-101 defines dangerous weapons and prohibits either carrying them concealed, or carrying them openly with the intent to injure someone. While an expandable baton is not listed, my experience in assault cases that I have defended has been that many seemingly ordinary things might qualify in the context of carrying them openly with the intent to injure someone. For instance, a ball point pen might be a dangerous weapon, if carried them openly with the intent to injure someone.

Check whether your City or County has any local ordinances that prohibit expandable batons.
