Legal Question in DUI Law in Maryland

license requirements

I had 2 DWI's, one in 1991 and 1995, I met all of the requirements to get my license back, i.e. rehab, Drinking driver monitor program, AA, and driver improvement. Then they made me have a ''medical review conference'', I have not been in any trouble in any way since my license was revoked. Now they say a condition to get my license I have to go throught the Drinking driver monitor program again and attend a certain amount of AA meetings a week. I feel I am being discriminated against, can I do anything about this?

Re: license requirements

You are not encountering discrimination. What you are

experiencing is the difficulty of having to appear before the

Motor Vehicle Administration's Medical Advisory Board (MAB).

The MAB has greater latitude than the Courts or the MVA Office of

Adminstrative Hearings. The basis of the MAB's decision is that they

deem you to be risk and you need to take affirmative steps to address this.

Once these steps are taken, you need to have your actions properly considered by

the MAB. Maintaining certain documentation is usually a foundation that is needed. Once your license is

revoked, the usual actions taken to address a DWI are not as effective. Accordingly, the advice and representation of an attorney is

extremely helpful. For instance, you will not be able to review your file at the MAB; however, with the proper authorizations, an attorney generally will be permitted to

review your file. In order to further help you, I need to know more details about your particular

situation. Please feel free to contact me at (410) 799-9002 or send e-mail to: [email protected].
