Legal Question in Family Law in Maryland

How to file for divorce

I would like to know how to go about filing for an uncontested absolute divorce in Prince Georges County, Maryland. Have been separated for almost 7 years with no children. Also, how soon after divorce can I get remarried.

Re: How to file for divorce

The Circuit Court clerk can provide you with a simple form for the filing of a complaint for absolute divorce. It would be foolish to do it this way in most cases, but in yours I think it makes sense, as it sounds as if there are no contested issues whatsoever. You will need to pay a filing fee, and your spouse will have to be served with a copy of the complaint. If he/she doesn't file an answer within thirty days, you will have to file a request for an order of default. I don't think there is any simple form for that, and the court clerk can't give you legal advice, so if it seems too complicated to handle alone you may need to consult with an attorney at some point. You will need to testify at a hearing before the divorce can be granted. After the judgment of divorce is issued, you should wait at least thirty days before getting remarried, since during those thirty days your spouse could file a request to re-open or reconsider the judgment. It isn't really final until those thirty days have passed.
