When He Won't Leave

I asked my husband of 14 years for a separation. Only problem: he won't leave the house. We have three children and I refuse to leave also. What should I do? We are beyond counseling.

You can file a court action for a limited divorce and ask for custody of the children. You would then also request a "use and possession" order

for the family home as the custodial parent ( I am assuming the childrens are minors-under 18). If granted, your husband will be required to leave the home pending the completion of the case and for up to three years thereafter. You should also seek child support from him.
