Modify visitation

My daughter is 6 years old and i have sole custody of her. She was going over her dads every other weekend untill we had a big fight and he tried to keep her. About a month later she told me how mean her dad is to her. Then the worst part was when she told me about her dads girlfriends 14year old son has been touching and doing things to her for a while now. The court date was just changed for the first time but she wants nothing to do with her dad. I just moved her form MD. to NC. So what do I do now to keep her safe and away from her dad???

You didn't indicate whether there is a formal custody/visitation order issued by a judge or if your custody is by consent. If there is no court order, you should inform dad that you cannot allow exposure of your daughter to the 14 yr old and unless he can insure that there will be none, further visitation is out of the question. You should also ask the police in MD (if that is where the abuse occurred) to investigate, especially since she may not be the only victim.

Is there an Order for custody in NC or MD? You can file a protective order on behalf of your child and seek protection from the 14 year old. You can also call social services and file a complaint with the police. Addtionally, you can file for a modification of custody in MD if you have an order or an initial complaint for custody if no order exist already. You can request supervised visitation for the father since he let the abuse occur and seek an order that prevents any contact with the 14 year old.
