ny vs md!

if my child resides in maryland can his dad serve me custody papers if he lives in ny? is that even legal to do.

If your child has lived in MD for at least 6 months and you didn't violate a NY court order to bring him/her here, MD would have jurisdiction over this case under an interstate law to which both MD and NY are parties. You could have a NY attorney move to dismiss the action or have it transferred to MD.
