Legal Question in Family Law in Maryland

property in divorce

I retained an attorney for a divorce. She says i can not make him sell the house we bought 20+ years ago or buy me out. Our seperation papers say ''when'' the house is sold we split the money. She says it is the word ''when'' that is the problem. I can't make him sell!

You have a poorly drafted separation,in that it doesn't set a timetable for selling the house. However, once the divorce is finalized, your joint ownership will be subject to a suit for partition and sale of the property. Hopefully your husband will decide to buy you out or sell if you advise him you intend to take this step.
