seperation and divorce

My wife and I are living with my mother and I want to seperate she refuses to leave and if she does wants to take daughter out of state. I dont want to loose my little girl she is only 6. We were seperated for a year prior to her moving in she lost everything not paying her bills. What are my options I cant live this way anymore. I would like custody if at all possible. Wife also lost her job after moving in.

You will have to file a court petition for custody of your daughter. Also, since you are living in your mother's home, legally she could force her to leave, since she's nothing more than a guest legally. But that would probably cause a lot of emotional trauma for your daughter. You should consult with a family law attorney about your options and how to proceed with a legal proceeding.
