Spousal Abuse

My question: Can my spouse refuse to pay bills and stay in the home? He refuse to leave the home.

If you are joint owners of the property, neither of you has a greater right to possession of the property than the other. However, if you have minor children and you have the grounds to file for a limited divorce, you could include a request for custody of the children and exclusive possession of the home. If that were granted, your husband would be ordered to leave. Also, you didn't mention it, but if he has assaulted or threatened you or any children, you could get an expulsion order by filing a domestic violence petition.
