Legal Question in Insurance Law in Maryland

house fire in january my brother passed in april house deed in both names and insurance in both names. House is now mine but the insurance company has not settled my claim..now they say half the fire insurance money has to go into a estate for my brother ..why would money go into estate for medical bills when it was a homeowners policy and open claim from fire of house.?

I am sorry to hear of your brother's passing and your house fire. To offer meaningful help an attorney should look at your deed (property can be held jointly several different ways and an owner's death has different effect depending on how it is titled), the details of the claim, any mortgage liens on the property and the applicable insurance policy.

If the insurance proceeds are for property damage only and go into the deceased owner's estate you may have a claim against the estate to get the proceeds back.
