Landlord in breach of contract?

2 months ago, two friends and I signed a lease to rent the 3 bedroom basement apartment of a house. 10 days ago we found out that he does not have the right permit or license to rent the basement, only the three upstairs rooms that he also rents. Can we get our security deposit and past rent payments back?

Does your landlord own the house within which these rooms in the basement are located? Also, in what city or county is the house located? Have you come across some city or county ordinance that prohibits the landlord from renting these particular rooms?
