Additionally, your insurance company will only provide legal counsel if a claim involves your insurance (this can happen if someone sues you or if you get $ from your uninsured motorist policy and your carrier tries to recoup this money) -- they have no reason or motivation to independently seek compensation for your injuries.

You are far better off having an attorney help you if you have been injured in an accident. It is important, however, to chose the correct attorney ie one well versed and experienced in claims involving personal injury. I would be happy to discuss with you further.

You can settle the matter on your own. Your insurance company will provide you with advice, but will not hire an attorney to represent you unless you are being sued by the other driver. In a traffic accident case, the other side's insurance company is looking to settle your case for as little money as possible. Although an attorney typically charges 1/3 of the gross amount recovered, in most cases, that is far less than you will be able to recover on your own.
