Legal Question in Wills and Trusts in Maryland

Uniformed Gift to Minors Act

I am trying to find the legal age at which a minor of a custodial account, in Maryland, reaches majority. The account is filed under the UGMA. In the past year, my mother has withdrawn almost all of the funds without my consent for her own purposes. She is the custodian of the account. Is this legal in Maryland? I am currently twenty years old.

Thank you for your time and help.

Re: Uniform Gift to Minors Act

First, it is the *Uniform* Transfers to Minors Act (UTMA).

The age of majority in Maryland is 18.

This answer intended to provide general information in response to the above inquiry and is not intended as legal advice. Should you desire additional information, please contact an attorney to discuss the particulars of your situation in greater detail.

The age of majority in Maryland is 18, although for purposes of the Uniform Tranfers to Minors Act (the successor to the Uniform Gifts to Minors Act), minority status remains until age 21 in most cases. A custodian is required to maintain complete records of all transactions involving the custodial account and a minor over age 14 is entitled to see those records. A minor, his or her guardian or representative may petition the court to require the custodian to provide an accounting of the funds or property in the custodial account. A custodian generally will be liable to the minor for any misuse or misappropriation of custodial property.

I hope this information has been helpful.
