Legal Question in Personal Injury in Massachusetts

My car was damaged last weekend by a snowplow in my son's apt. complex parking lot. The apt. complex management filled out a form and told my son to contact the landscaping company it had hired to clear the snow. There were no witnesses to the event, but we know that the damage was caused by a snowplow. The police officer who filled out the accident report states that the damage he saw is consistent with what would have been caused by a snowplow. My son has left several messages with the landscaping company, but they have been unresponsive. If they don't respond, is the apt. management responsible for the damage since they hired the company to plow? Any suggestions?

In the event the landscaping company does not respond, the apartment management does not legally guarantee your car will not be damaged by anyone and I would think it unlikely you would have a legal right to recover from it. Most people buy property insurance on their car for such contingencies, but people who do not may hire legal counsel to attempt to pursue recovery from potentially responsible parties. Best luck.
