Legal Question in Bankruptcy in Massachusetts

When can my daughter own a car in her name after filing bankruptcy?

My daughter claimed bankruptcy in October 2005. Is there a time limit on when she can own a car in her own name. Right now the car she drives is in my husband's and my name. She does not live in Mass with us, she lives in NH. We would like to transfer ownership of the car to her.

Please advise. Thank you.

Re: When can my daughter own a car in her name after filing bankruptcy?

It depends on what kind of bankruptcy she claimed. If she claimed chapter 7 and has received her discharge, she is free to go about her life as she sees fit. If she claimed chapter 13, she probably is still in bankruptcy and thus should not receive or sell any property without the court's permission. She should consult with the attorney who helped her file the bankruptcy case for advice about her particular situation.
