Legal Question in Bankruptcy in Massachusetts

I filed a skeletal petition for CH13 on 2/16 to prevent the sale of my home. 2/17 I filed a homestead. 3/18 I filed the remained of the paperwork (ProSe) for CH13. I went to the 341 meeting to find out all the things I did wrong. The biggest thing is that the homestead is invalid the day after the original filing. So - can I withdraw and refile to include the homestead? Any options or is it hopeless?

Thank you kindly,

Cathy D

Cathy, no offense, but you are mistaken to attempt to file a Chapter 13 on your own. According to Massachusetts Bankruptcy statistics, something like one pro se leads to a discharge every two years. The odds are very, very, high that you will fail.

You need to spend the $3500.00, and speak to a bankruptcy attorney immediately. If you want a referral, or want to talk to me: 617-230-2779; [email protected]

You need to seek competent bankruptcy counsel who is experienced with filing chapter 13 petitions. Going it alone on a chapter 13 is ripe for failure. If you cannot afford the entire attorney fee, most attorneys have some type of payment plan available. There are solutions available. Feel free to contact me.
