How do a fight a auto damage claim denial from a valet parking company?

I valet parked at a restaurant who employs another company to provide valet service. I left the restaurant and noticed 10 minutes later that I had engine trouble and heard a noise. My car kept accelerating and there was a loud sound from the rear of my car. I own a 1996 Ford Taurus station wagon which I maintain very well. I called the restaurant who forwarded their call to the valet parker. I took his contact information and contacted him the next day. I found that my accelerator was stuck and caused me to exceed in speed when I left the restaurant and that the muffler system was damaged. The valet company told me that they are denying my claim as I reported it after I left the restaurant. They also said they have pictures of where my car was parked that will show there could not of been damage caused by them. I have 400 in damages plus a lost days pay. I can't prove otherwise they did the damage except for my repair bill. How can I collect my auto damages and lost days pay and prove my case to the valet parking company?

All you can do is file a small claims case. While the damage may not have been readily apparent when you left the valet, you may get somewhere with small claims.

However, your complaint may not be related to anything the Valet did. Your car is 12 years old and eventually parts wear-out. However, if the garage who handled the repair thinks it was the result of an accident or abuse, then maybe you have a good claim.

You can bring an action for recovery of monies allegedly owed.
