Legal Question in Business Law in Massachusetts

unnaceptable company seriveand response

We bought a natural gas free standing fireplace.

The company gave us a propane one, which we did not realize until installation.

They have taken 6 weeks to get a part that modifies propane heater to natural gas.(they have the part apparently) Then said they would their plummer to intall it at no charge.

Nothing has happened yet (7 weeks since purchase). When we call the guy is not there etc.

He said he would get it taken care of ..nothing happens. We have been very patient, but this is a nightmare. We need something done NOW.

What are our best options ...we have been verypatient but now are absolutely fed up..and angry!

The sales document says : All sales are final/no credits issued.

But surely in light of their error ..that cannott be binding.

Can you please advise.

Thank You

G.P. Alexander

Re: unnaceptable company seriveand response

Make a written chronology of all contact with the company since you discovered their error along with all costs you have incurred as a result, and take it along with the written sales contract and all writings and correspondence you have had with the company to an attorney who can then best advise you as to how to proceed.

Good Luck!

Do exactly as Attorney Murray says. You should at least check with an attorney who practices consumer protection law.

How to proceed will depend largely upon the value of the product and services contracted for.
