Legal Question in Civil Rights Law in Massachusetts

right to sue

I previouly ask about a lawyer who would not give court transcripts to a newly retaind lawyer. Since then I reported him to the bar of overseers and he still has not responded to there request to mail the transcripts. I was then told he lost the transcripts. Can I sue him for negligence and for the cost of getting transcripts from the court, also do we have any recourse of getting back the the money we paid him for originally reading the transcripts.

I have written a formal complaint to the bar and I am awaiting their responce.

Re: right to sue

If he lost the transcripts, he can re-order and pay the charge. If you didn't notify the Board that he lost them, call and amend your complaint. If, as a result of losing your material you lost your suit, you can sue for legal malpractice. If you haven't asked for your money back, do so. If he refuses, you can sue him in small claims court.
