Contactor took a deposit and vanished

I gave a paving contractor a deposit ($3k) for a new drive way. He cashed the check and has not returned any of my calls. In researching his company, I can't find any record of him registered with the state and it appears that he may have given me a false address. I can find record of him under another construction company, but the phone number associated with it is no longer in service. How should I proceede? Should I file suite against him or criminal chagres?

Concurrently with the criminal matters per Attorney Murber's advice, you may have rights under the Massachusetts Consumer Protection Law, Chapter 93A. If willful deceptive conduct can be proven (and it sounds like it here) you may be entitled to three times the amount you paid to the contractor plus attorneys fees. Report it to the police department in the district the event occurred and a complaint should be issued to the court and should be brought forward against this individual if the court determines there is probable cause. If what you are saying is correct, the court should have no problem finding probable cause to proceed in prosecuting this individual. Good luck! P.S. I would do this today! Sincerely, Maria Murber
