Legal Question in Consumer Law in Massachusetts

Internet Purchase

Hello, I purchased a dress over the internet. It was a mother of the bride dress. They took the money out immediatley in Dec. I then inquired about my dress, where it was, ect..they told me it was on its way and then took out another $250. I told them I already paid for the dress nd they should refund my origianal payment. After a million emails, they made a dep. Now, I got the dress, hate it and have returned it. To this date, and many emails again, I have not recieved any money for the dress return. This has been going on since Jan and it is now April. Is there anything I can do to get the money back for the dress I returned?

The standard attorney answer likely applies: 'it depends.'

Where is the company located? If they are in mass then an attorney may take your case on a contingency fee basis, which means you will not pay legal fees until there is a recovery. If the value of the dress is less than a few hundred dollars then you may have to handle this one without an attorney. Either way you should call your lawyer to see what can be done.

If an attorney is unable to take the case because of the low dollar figure, you may want to send the company a certified letter stating that you are entitled to a refund.
