Legal Question in Credit and Debt Law in Massachusetts

10 year old debt

I have a 10 year old debt with a judgement brought against me in 1989 in Maine. I now have a law firm(Mass...debt collector) trying to reach me. They have stated that they can evaluate my wages and have automatic payment demanded. Can they do this? The statue of limitation im Mass is 7 years do they really have any power over me?

1) Who told you that the Mass. statute of limitations is 7 years?

2) Anyway, Mass. statute of limitations does not apply.

3) What was the judgment for and in what amount?

How long have you been here in Mass.? Were you here when the judgment

was obtained?

What's the name of the law firm?

Did they make those statements

about what they can do in writing or just over the phone?

I imagine that was over the phone ... normally one would say that

they plan to "attach" or "garnishee" your wages, not "evaluate".

Have you asked them not to call any more? (I don't necessarily

recommend that yet.) Have you written to them saying that?

What month in 1989 did the judgment against you get handed down?

Have you lived in the same place all these years? Has there been

any subsequent court activity since that judgment was handed down?

I would need to know more about the situation to evaluate your problem.

A Massachusetts judgment is vaild for 20 years. I would have to reasearch

how long a Maine judgment is valid.

The law firm in Massachusetts can file an action to enforce the Maine judgment in Massachusetts.

If they win, they may then be able to garnish your wages, the firt 125.00 per week is exempt.

Were you properly served in 1989 or did you default and only find out there was a judgment against you when the

Massachusetts firm sought to enforce the Maine judgment?

Where were you living when suit was brought against you in Maine?

Do you have assets other than your pay check, pension, car and house with little or no equity? Are there other debts you owe?

Would a bankruptcy help? You will be very suprised at how much you can keep through a bankruptcy, if your lawyer knows what he is doing.

I may be able to settle the case with the creditor's lawyer for much less then you owe, are you interested?
