Re: Summons [rule 4]

Assuming this case is in Small Claims court, you can send a written response to the court in response to the bank's claim. This response should set out reasons in clear and simple language why the bank should not prevail on its claim. You are not required to send any response if the matter is in Small Claims court (amount is under $2,000.00). The response should be sent to the clerk of courts. You can also file a counterclaim asserting any claims you may have against the bank. The counterclaim needs to be filed 10 days prior to the hearing and should be sent to the bank's attorney and court. Keep in mind this answer assumes you are in Small Claims court. If you are in District Court, you should try to hire an attorney since the rules are more complex and you are required to file an answer or you will be defaulted.
