Re: assault on ex girlfriends new boyfriend

The maximum penalty is 2 and half years. However, it is hard to know what you are facing. If it is your first offense EVER, anywhere in the world from the day you were born until today, AND if you did not violate a restraining order, you are unlikely to go to jail unless there was serious injury.

It sounds as if you may have some defenses here-- ie. self defense.

You should immediately:

1. retain an attorney

2. Do not speak with anyone about this incident

3. Talk to youir attorney about sending a letter to the local district court requesting a hearing before the issuanc of any complaint

4. Talk to your attorney about a "cross complaint" against anyone else who may have committed a crime here.

In addition to the foregoing, all of which should be treated as gospel. There are 5th amendment issues, and a civil litigation potential.

call or email if you need further information.
