Legal Question in Criminal Law in Massachusetts

Continued without finding

My son's case was ''continued without a finding'' for 6 months when he went to court in Nov. 2002. The charges were disturbing the peace, assault and bat. and assault/battery on a police officer. His lawyer pleaded not guilty to judge, no trial took place.

This is showing up on public records as he searches for a job. This is the only time he has been arrested/in trouble with the law.

What happens in 6 months if he does not get in any other trouble? Does this now disappear? Will he have a permanent records? If he stays out of trouble, is this treated like it did not happen. Please help an anguished mom of a struggling college kid who needs to work. Many thanks.

Re: Continued without finding

Continued without a finding means that no guilty finding was made. Other than police and courts, nobody should be able to find out about this. While the court file is a public record, if someone looks at his criminal record, this should not appear.
