Legal Question in Criminal Law in Massachusetts

Expunging an arrest record

Can an arrest record be expunged in Ma? Charges were assault and battery (domestic), and restraining order violation. Accusations against me easily shown to be lies, charges dropped. But I still have the arrest record, thanks to the policy of police in this state to be able to arrest someone merely on an accusation (so much for the Constitution). Although it's not a major issue, there are times where I have to explain the arrest record (aviation career, background checks for security clearance), although I have retained all paperwork that shows the charges were untrue and vindictive, I'm not so sure it would be easier to simply have the record clean. Appreciate any help/suggestions. Thank you.

Re: Expunging an arrest record

Yes, as of last March, you can get ROs expunged.

Must be carefully done.

Ditto for the A&B.

Re: Expunging an arrest record

Expunging: The problem with your question is if the arrest led to a complaint, and if yes, what happened. Arrest records are usually official documents within the police station, and almost never expunged or sealed. However, there are rules that involve those matters that get to court. Should you have more information, and want to convey this to me, contact me.
