can i request a diff. court date then what wasassinged by the court i,m going to be out of state the day they assinged to me can they say no.

It is fairly easy to get a court date changed if you go to the court ahead of time. It is easier if you are represented to have an attorney do it for you. If you are unrepresented you usually have to go to the DA and have them agree to continue the case, then file an agreed upon motion with the DA's office

Sure, you can request a different date. Why not have your attorney request a different date?? If you are unrepresented by an attorney, and you are going out of state, the judge may think that you scheduled your trip after you were assigned the Court date, and he or she will not be very happy about it. They could say no. If you did not show up, you would be defaulted, and a warrant for your arrest could issue. You could then be picked up and held in jail until the Court was next in session (From friday night until Monday morning, for example). If yoiu cannot make your court date, better get an attorney to run interference for you, ASAP....

You need to bring a motion to continue. This motion must be heard in advance of the court date. While technically you must give seven days notice before the motion is heard, many times the court will allow you to file it and have it heard in the same day. Go to the criminal clerk's office and tell them you want to file a motion to continue.
