Breat Test Refusals

Won't I lose my license for 6 months or more if I refuse to take the breat test in an Operating Under the Influence of Alcohol (OUI/DWI/DUI) investigation?

Breath Test Refusals

Initially, you will lose your license for varying periods starting at 6 months (see our website at www.LawWorcester.com for how long the loss is for each situation). However, without the breath test, there is a much stronger chance that you will be found not guilty at trial and if found not guilty, the judge must, in many cases, order the Registry of Motor Vehicles to reinstate your license before the loss period. In fact, many times, without breath test evidence, a jury waived trial may be held within a month or less of your arrest and if found not guilty, the license reinstatement can be shorter that if you took the test and failed.
