Legal Question in DUI Law in Massachusetts

car accident alcohol related

I was not charged with anything, I hit a telephone pole spoke with a police officer, was very disoriented, and I had alcohol earlier in the evening. I was brought to the hopsital the paramedic recommended it due to low blood sugar. and while at the hospital i was asked to blow into a machine (i was still confused at the time) which turns out was a breathalyzer and blew a .1. The dr. told me ''It's okay it happend here'' Will these results be used in the incident report for the police? Will I be charged with a DUI?

Re: car accident alcohol related

It is possible that the results could be used against you. If you are in Massachustts you can contact me, or if you are in Rhode Island you should contact a Rhode Island Lawyer. I know one who practices in RI regularly, and is quite good.

You should retain an attorney and discuss this matter ONLY within the attorney/client privilege as there is no reason that the state could not subpeona thise medical tests results if they are inclined to bring charges against you arising from the accident.
