DUI Limitations

Is there a statue of limitations on a warranty for DUI. He received a DUI 3 years ago, didn't show up for the court hearding and now has a warrant out for his arrest. He didn't show up becuause he had moved across the country. If he returns to Massachusetts will he go to jail or is there a statue of limitations?

There is no limitation on a warrant.

It exists for ever.

What happens depends on the individual's circumstances.

There is no limitation on outstanding default/arrest warrants and this person will be arrested on that warrant if he is located in Massachusetts.

He should retain an attorney and speak to no one else about resolving this matter.

Once issued, the warrant will live forever, or until it is "recalled" when the person shows up in court. I can't tell you if this person is looking at jail time, or not, because I don't know enough about the offense. Certain repeat DUI offenses carry mandatory jail terms while others do not. It depends on the person's record. In any event, his license is probably suspended and will remain that way until the warrant is dealt with. It is possible, however, that the case can be won at trial, or that he may be able to get probation and avoid jail altogehter.
