Legal Question in DUI Law in Massachusetts

Out-of-state violation

Hi,

my good friend was arrested in the state of New Hampshire for drunk driving. He is a Mass resident. In NH, first drunk driving case is not criminal offense - it is a violation. But in MA, where he lives, even first case is a criminal offense. I know that penalties in NH are fees and license suspention. What will be consequences in MA? Several NH lawyers said that penalties in MA cann't be higher than in NH - and so he wont have criminal record. Is that true?

If he has a conviction in New Hampshire for a first offense DUI and he has a Massachusetts license then he will lose his license in MA for 1 year. If he enrolls in a court sponsored alcohol education program he can go to the registry and petition to get his license back after a 45 day suspension. If he does not have a criminal record in NH then he won't have a criminal record in MA
