Legal Question in Family Law in Massachusetts

adjusting child support payments

I am a divorced father with 2 children. My son turned 19 this year and my support for him ended when he graduated in June. My daughter is 18. I will remain to pay support for her until she is emancipated as well.

I have been trying to work with my x to try to come up an amicable agreement without having to bring this to court. I gave her the proper paperwork to fill out so we can calculate what I need to pay her. She refuses to fill this out. She says she deserves more money and she wants the tax deduction as well. I am willing to surrender the deduction to her if she will fill out the paperwork and make my support payments appropriate. I now give her a little more than half of what I was giving her prior to June. She makes a least $10,000 more than I do each year, but is not willing to work this out. I will pay whatever support I need to pay. I don't want to get screwed here. I try to get her to talk to me about this but she either ignores my phonecalls or lays out her demands. This is child support for our daughter-not a bargaining tool for her to get more money out of me. I think I need to bring this to court, but I am hoping there is an easier way to solve this. Thank you.

Re: adjusting child support payments

If your ex-wife won't cooperate out of court then the only choice you have is to take the matter to a judge.
