Legal Question in Family Law in Massachusetts

Complaint for Modification

I filed a Complaint for Modification (massachusetts). I asked the court to reappoint the GAL because there had been instances between father and our two boys (ages 10 and 12) where there was inappropriate behavior - violence - one incident he had my 12 yr olds head in a lock between his legs. We have 50/50 custody. I filed paperwork myself, had it served it on my ex, he had his lawyer respond, of course denying everything and asking me to pay his legal fees. Can I now counter and respond to his response?

Re: Complaint for Modification

You must file an Answer to any counterclaim he filed. SO long as your concerns were reasonable and based in fact, the court is unlikely to assess you for the father's attorney's fees, though of course the court has the power to do so.

When in doubt, engage an attorney, especially if it is important (e.g., protecting your children).
