Legal Question in Family Law in Massachusetts

The court ordered the sale of the marital home and the escrow check was sent to my ex-husband's lawyer. I have not been served any papers to return to court for the division of the proceeds. What do I have to do?

I assume you do not have an attorney;

Unless there is a court order regarding division, the money continues to be held in escrow until there is an order or until the case is done, and the court decides on or oks a distribution.

If you would like the assistance of counsel, please do not hesitate to contact my office. It is possible that the proceeds will be divided as part of your divorce, and are being held in escrow until such time as the court has made an equitable division of the marital assets.
