Legal Question in Family Law in Massachusetts

My exgirlfriend and i have a 10 month old son and she has a 4 year old daughter whom I've been her father for more than 2 years now. Her biological father isn't around much if at all and rarely calls. Do I have any right towards her and do I need to file for custudy of both my kids if she moves to another state or can we have a written argement between us?

Your are considered a step-parent to your ex-girlfriend's 4 year old. If you were interested in adopting the child, you and your ex-girlfriend can petition the court for a step-parent adoption. The biological father's rights would have to be terminated, or voluntarily given up by him, in order for the adoption to proceed.
