Legal Question in Family Law in Massachusetts

I am leaving my husband whom is in the navy and has refused to accept I want a divorce, we are now in NC but our residency is in Florida. I am going to Mass. How long will I have to be there to be a resident? We have 3 children also, how can I protect them from being taken by him legaly?

Please help, thank you

If your legal residence is Florida, you might want to file in Florida. You would seek permission there (if necessary) to bring the children here. If you bring the children to Massachusetts without permission, your husband could file elsewhere (Florida, possibly NC) for custody. Massachusetts has a waiting period of one year.
