Legal Question in Family Law in Massachusetts

non custodial parent traveling

My exhusband has custody of 2 of our 3 children. The oldest lives with me but is now 20 years old. I pay child support weekly and have no arrears.

I see the 2 boys every other weekend per court order. Sometimes more often.

I have an opportunity to travel to Italy from 1 to 3 months. Is it necessary for me to notify Probate Court? I obviously will not be able to see my boys during this travel period. My exhusband is not always ''reasonable'' and can tend to cause trouble for me when he can. Since i do not have custody, is it ok for me to leave as long as i continue the child support payments? thank you very much.

It's very difficult to respond to this type of question, because family law matters have so many different dynamics with each case. You say your ex is difficult. If you think he will cause some problem with your going to Italy, then perhaps you should go to Court and get permission. Without knowing more facts, that's the best I can offer.
