after the papers are returned that were served by sheriff, how long before a court date is given

You have to file a Motion with the court if you want temporary orders. If you do not, then you need to return the summons and complaint that were served by the sheriff to the court. The court should then schedule a status conference or pre-trial hearing. Schedules vary by county. You should contact an attorney if you are unsure of the process and/or your rights.
